Resolves TRUE if Apple's EBITDA margin (EBITDA divided by total revenue, trailing twelve months, from reported financials) reaches at least 33% — the midpoint of the stated 'the 30s and mid 30s' range — in any reported period on or before 2026-03-03; FALSE if it stays below 33% throughout.
Criterion threshold is EBITDA/revenue (TTM) >= 33% in ANY reported period on or before 2026-03-03. Using Apple's own reported operating income plus cash-flow-statement D&A (the standard EBITDA build, since Apple does not report EBITDA), the margin is 34.44% for FY2024 (reported 2024-10-31), 34.78% for FY2025 (reported 2025-10-30), and 35.10% on a TTM basis through the December 27, 2025 quarter reported in January 2026. Well clear of 33% and clearly satisfied before the deadline. resolved_on is set to Apple's FY2024 results publication date, the earliest date at which a primary-sourced reported period demonstrably exceeded 33%; the condition was very likely met earlier still (FY2022 works out to roughly 33.1% using operating income $119,437M plus D&A of about $11.1B), but I did not pull the FY2022 D&A from a primary document, so I anchored the resolution date on the FY2024 figures, which are primary-sourced. Note also the starting point of the claim checks out directionally: Apple's FY2020 EBITDA margin was about 28% ((66.3+11.1)/274.5), close to the ~29% he cited. No conflicting evidence found. Caveat for the scorer: EBITDA is not a GAAP-reported Apple line item, so the margin depends on the D&A definition used (cash-flow D&A here, which excludes share-based compensation); adding SBC would raise the margin further, and no reasonable variant puts it below 33%.

Evidence of what happened
Apple's own FY2025 Q4 condensed consolidated financial statements (unaudited): twelve months ended September 27, 2025 total net sales $416,161M and operating income $133,050M; cash-flow statement depreciation and amortization $11,698M. EBITDA = 133,050 + 11,698 = $144,748M, i.e. 34.78% of revenue. The same document gives the FY2024 comparatives: total net sales $391,035M, operating income $123,216M, D&A $11,445M -> EBITDA $134,661M = 34.44% of revenue. Both fiscal years are above the 33% threshold.
Apple's FY2026 Q1 condensed consolidated financial statements (quarter ended December 27, 2025): total net sales $143,756M, operating income $50,852M, D&A $3,214M; year-ago quarter (ended December 28, 2024) $124,300M / $42,832M / $3,080M. Rolling the quarter into FY2025 gives TTM through 2025-12-27: revenue $435,617M, operating income $141,070M, D&A $11,832M -> EBITDA $152,902M = 35.10% EBITDA margin. This is the last TTM period reported before the 2026-03-03 deadline and it is above 33%.
Apple newsroom press release for the first fiscal quarter of 2026 confirms the reporting date (January 2026, quarter ended December 27, 2025) and quarterly revenue of $143.8 billion, up 16% year over year - establishing that this period was reported on or before 2026-03-03.
Aggregator cross-check of Apple annual income statements: FY2021 revenue $365,817M / operating income $108,949M; FY2022 $394,328M / $119,437M; FY2023 $383,285M / $114,301M; FY2024 $391,035M / $123,216M; FY2025 $416,161M / $133,050M. Consistent with the figures taken from Apple's own statements.
